Welcome to PoolBox. By accessing our website, purchasing products, or enrolling in a PoolBox subscription, you agree to be bound by the following Terms of Service (“Terms”). Please read them carefully.

If you do not agree to these Terms, you may not use our services.

 

 

1. Company Overview

PoolBox provides pool chemical subscriptions and à la carte chemical products delivered using internal company resources within a limited service radius.

PoolBox reserves the right to modify, suspend, or discontinue services at any time.

 

 

2. Eligibility & Service Area

PoolBox services are available only to customers located within our approved delivery radius.

By placing an order, you confirm that:

  • Your delivery address is accurate

  • You are within the PoolBox service area

  • You are legally capable of entering into a binding agreement

PoolBox may refuse service to any address or customer at its discretion.

 

 

3. Subscription Services

Subscription Enrollment

PoolBox offers recurring subscription plans, including but not limited to:

  • Essential

  • Signature

  • Elite

Subscriptions renew automatically unless canceled in accordance with Section 7.

 

 

Subscription Delivery Schedule

All subscription deliveries are fulfilled on a fixed schedule:

  • First Monday of each month

  • Third Monday of each month

Delivery timing is not based on sign-up date. By subscribing, you acknowledge and accept this standardized delivery cadence.

 

 

4. À La Carte Chemical Purchases

Chemical products purchased outside of a PoolBox subscription (“à la carte”) are sold as-is and are subject to the following conditions:

  • All à la carte chemical sales are final

  • No returns or refunds are permitted once delivery is completed

  • PoolBox is not responsible for improper use or storage after delivery

 

 

5. Proper Use & Customer Responsibility

Customers are responsible for:

  • Following all PoolBox instructions exactly as provided

  • Adding chemicals in the correct order and quantities

  • Avoiding interference from non-PoolBox chemicals unless instructed

Failure to follow instructions voids any eligibility for refunds, replacements, or corrective service.

 

 

6. Refunds & Service Resolution

Refunds for subscription orders may be considered only after PoolBox has had a reasonable opportunity to:

  • Review documentation

  • Provide guidance

  • Dispatch a technician (when applicable)

Customers requesting a refund must provide verifiable proof of proper chemical application, which may include:

  • Logs or notes

  • Photos or videos

  • Water test results

Improper chemical use is the most common cause of pool issues and does not qualify for a refund.

All refund decisions are made at PoolBox’s sole discretion.

 

 

7. Cancellations & Account Changes

Subscription Cancellations

Customers may cancel their subscription at any time. However:

  • Cancellations must be submitted before the next scheduled delivery window

  • Orders already scheduled or in process cannot be canceled or refunded

 

 

8. Shipping & Delivery

PoolBox fulfills deliveries using internal company resources.

Delivery timelines are estimates and may vary due to:

  • Weather

  • Route volume

  • Operational constraints

Customers must report any delivery damage within 24 hours of receipt. Claims submitted after this window are null and void.

Shipping fees, including express or priority delivery, are non-refundable.

 

 

9. Limitation of Liability

To the fullest extent permitted by law, PoolBox shall not be liable for:

  • Pool damage caused by improper chemical use

  • Equipment failure (filters, pumps, heaters, etc.)

  • Environmental factors (weather, heavy use, contamination)

  • Losses resulting from customer negligence or third-party interference

PoolBox’s total liability shall not exceed the amount paid by the customer for the affected order.

 

 

10. Assumption of Risk

Pool chemicals are inherently hazardous if misused. By purchasing from PoolBox, customers acknowledge and accept all risks associated with chemical handling and application.

PoolBox is not responsible for injuries, property damage, or losses resulting from improper use.

 

 

11. Policy Abuse & Termination

PoolBox reserves the right to:

  • Deny refunds or service

  • Suspend or terminate accounts

  • Refuse future service

for customers who abuse policies, misrepresent information, or repeatedly violate these Terms.

 

 

12. Intellectual Property

All content, branding, logos, instructions, and materials provided by PoolBox are the exclusive property of PoolBox and may not be copied, reproduced, or distributed without written permission.

 

 

13. Changes to Terms

PoolBox may update these Terms at any time. Continued use of services constitutes acceptance of any changes.

 

 

14. Governing Law

These Terms shall be governed by and interpreted under the laws of the state in which PoolBox operates, without regard to conflict of law principles.
